These terms apply when you use our website at outdoorcinemapro.com.au and our online store at shop.outdoorcinemapro.com.au, and when you buy goods from us. They are offered by OC Pro Pty Ltd (ABN 28 669 737 991), trading as Outdoor Cinema Pro (“we”, “us”).
They should be read with our Shipping Policy, Refund Policy and Privacy Policy, which form part of these terms. Where we give you a written quote, the quote’s terms also apply, and take priority if they differ from these terms.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, including the consumer guarantees. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. See our Refund Policy for how we handle faulty items.
We take care to describe our products accurately, including specifications, sizes and inclusions. Product images are for illustration: colours may vary between screens, and images may show accessories that are sold separately — check the listed inclusions. Manufacturers sometimes change specifications; where this materially affects an order, we will tell you before dispatch.
Information and guides on our website are general in nature. They do not replace site-specific advice for your venue, conditions or event, which we are happy to provide.
Prices are in Australian dollars and include GST. Shipping is charged separately unless stated otherwise and is shown at checkout. We may change prices at any time, but changes do not affect orders we have already accepted.
If a product is listed at an obviously incorrect price because of an error, we will contact you before processing the order. You can choose to proceed at the correct price or cancel for a full refund.
When you place an order, you are making an offer to buy. The order confirmation email you receive acknowledges that we have received your order. A contract is formed when we accept your order, which happens when we dispatch the goods or confirm acceptance in writing.
We may decline or cancel an order before dispatch — for example if an item is unavailable, a price or description is wrong, shipping to your location is not viable, or we reasonably suspect fraud. If we do, we will tell you and refund any amount you have paid in full.
Online orders are paid in full at checkout through Shopify and its payment providers. Quoted orders are payable as set out in the quote or invoice. We will issue a tax invoice for every purchase.
Delivery is covered by our Shipping Policy. Delivery times are estimates. Risk in the goods passes to you on delivery or collection, and ownership passes to you once we have received payment in full.
Please install and use products in line with the manufacturer’s instructions and safety information, and any relevant local requirements. In particular, inflatable screens must be properly anchored and must not be used in winds above the manufacturer’s rating, and electrical equipment must be protected from the weather as directed. Faults caused by misuse, accident or use outside the manufacturer’s instructions are not covered by the manufacturer’s warranty.
If you buy goods that are not of a kind ordinarily acquired for personal, domestic or household use, then to the extent the law allows, our liability for failing to comply with a consumer guarantee (other than those relating to title, undisturbed possession and freedom from undisclosed securities) is limited to, at our option, replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect or consequential loss — such as loss of profit, revenue or business opportunity — arising from your use of our website or products, except where it is caused by our negligence or breach of these terms and was reasonably foreseeable.
You may use our website for lawful purposes only. You must not attempt to interfere with its operation or security, or copy its content for commercial use without our permission. The website’s content, design, images and guides are owned by us or our licensors and protected by copyright.
Our website may link to other websites, such as manufacturers’ sites. We are not responsible for their content or practices.
We may update these terms from time to time. The version published on our website when you place your order applies to that order.
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria.
